    Justice Over Celebrity: Apex Court Sets Aside Bail in High-Profile Murder Trial

    Court Stresses Equality Before Law, Cites Legal Lapses in HC Order

    Background of the Case

    On August 13, 2025, the Supreme Court overturned the bail granted to Kannada actors Darshan, Pavitra Gowda, and five others—Nagaraju R., Anu Kumar (also known as Anu), Lakshman M, Jagadeesh (also known as Jagga), and Pradoosh S Rao (also known as Pradoosh)—in connection with the Renukaswamy murder case.

    The Karnataka High Court had given them bail in December 2024. However, the State of Karnataka appealed this decision, claiming serious procedural and legal mistakes.

    Supreme Court’s Findings

    A bench of Justice J B Pardiwala and Justice R Mahadevan found that the High Court’s order “suffers from serious legal weaknesses” and lacked “special or clear reasons” for granting bail in a case involving Sections 302 and 34 IPC.

    The Court criticized the High Court for:

    Conducting a thorough pre-trial review of witness statements and pointing out alleged contradictions and delays; these matters should be looked at during the trial.

    Leaving out legally relevant facts when granting bail. Not considering the nature and seriousness of the offence, the role of each accused, and the risk of interfering with the trial.

    Threat to Justice

    The bench noted that the “liberty granted under the challenged order poses a real and serious threat to the fair administration of justice,” considering the strong forensic and circumstantial evidence and credible claims of witness intimidation.

    The Court emphasized that allowing bail in these circumstances represented a “wrong and improper use of discretion.”

    Principle of Equality Before Law

    Referring to Article 14 of the Constitution, the Supreme Court reiterated that popularity or privilege does not put anyone above the law. Everyone is equally subject to legal examination.

    Directions Issued

    The Court:

    • Cancelled the bail granted by the High Court on December 13, 2024.
    • Ordered authorities to take the accused into custody immediately.
    • Demanded that the trial be conducted quickly and concluded fairly under the law.
    • Clarified that its remarks are limited to the bail issue and will not impact the trial’s outcome.
