The Nagpur bench of the Bombay High Court has recently ruled that individuals must behave with a sense of responsibility when communicating via their WhatsApp status. The court denied relief to the petitioner who had posted content allegedly spreading hatred against a religious group. The court rejected the plea of Kishor Landkar, who requested that the FIR filed against him be annulled. The FIR was filed for offences under the Indian Penal Code for deliberately hurting or insulting religious beliefs or faith, as well as provisions of the SCST (Prevention of Atrocities) Act and the IT Act.
The court noted that people often check the WhatsApp status of their contacts and that the purpose of WhatsApp status nowadays is to convey something to your contacts. The court also stated that the applicant cannot shed his responsibility by claiming that the WhatsApp status is limited circulation. This ruling serves as a reminder to exercise caution and responsibility when communicating via social media platforms.
