THE MP High Court has recently upheld a Divorce Decree granted by the family court on the ground of cruelty and desertion, filed by a husband against his wife. The family court found both the grounds to be proven, but granted the divorce only on the basis of ‘cruelty’ due to technical reasons.
The High Court noted that when a wife displays disrespect towards her husband and his family, it constitutes cruel behavior towards the husband. The bench of Justice Sheel Nagu and Justice Virender Singh made this observation while dismissing the wife’s appeal against the divorce decree.
In her appeal, the wife had alleged that it was her husband’s behavior towards her that had compelled her to leave their matrimonial home along with their minor son. However, it was the husband who had filed the plea for divorce on the ground of cruelty and desertion, which was found to be proven by the family court.
The High Court’s ruling reinforces the importance of respecting one’s spouse and their family in a marriage, and highlights the consequences of failing to do so.
