    How AI Challenges Personality Rights and Cultural Expression

    In an era where technology is advancing at breakneck speed, the rise of fake celebrities through the manipulation of artificial intelligence tools has become a glaring issue. These AI-powered instruments, including deepfakes and manipulated videos, have evolved to such an extent that they can create realistic yet deceptive depictions of famous personalities. As the boundaries between reality and manipulation blur, celebrities are finding themselves in a battle to protect their rights over their own persona.

     A recent legal case by Anil Kapoor and a viral fake video of Rashmika Mandanna highlight the potential harms and challenges posed by these AI tools, as well as the need for a thoughtful approach to address them, while respecting the broader aspects of cultural expression and language evolution

    The recent legal victory by Bollywood icon Anil Kapoor serves as a pivotal moment in this ongoing struggle. Anil Kapoor, renowned for his iconic catchphrase “jhakaas” from the 1985 film ‘Yudh,’ successfully won a case against the unauthorised commercial use of his persona. This encompassed not only his name and image but also his voice and signature. The Delhi High Court’s decision marked a significant milestone by recognising Kapoor’s “personality rights” and establishing a precedent for addressing the misuse of AI tools that can alter an individual’s appearance and voice for deceptive purposes.

    The right of publicity is enshrined as a fundamental right under Article 21 of the Indian Constitution, safeguarding life and personal liberty. The Supreme Court has further reinforced the importance of publicity as an aspect of privacy in the case of Justice KS Puttuswamy (Retd) v Union of India. This legal framework provides a crucial shield against the improper monetisation of one’s persona.

    However, this legal victory has sparked a complex debate, one that delves into the nuances of celebrities’ rights over their persona. It becomes especially contentious when it involves commonly used language phrases associated with them. Critics argue that granting such rights could stifle cultural expression and hinder the evolution of language. After all, language is a shared resource that should not be monopolised by individuals. On the opposing side of the spectrum, supporters argue that when certain phrases become integral to a celebrity’s persona, they should be protected. This protection is necessary to prevent misleading endorsements and to ensure that celebrities maintain control over their own identity.

India’s information technology minister has voiced concerns, categorising these deepfake videos as a more “damaging form of misinformation.” This serves as a stark reminder to social media platforms of their legal obligations in the fight against misinformation. Even veteran Bollywood actor Amitabh Bachchan, who had co-starred with Ms. Mandanna in a film just last year, has noted “a strong case for legal action.” The distress expressed by both Ms. Mandanna and Ms. Patel underscores the urgency in addressing the issue at hand.

    These incidents vividly illustrate the potential harms and challenges posed by AI tools, such as deepfakes and manipulated videos. These tools can effectively create fake celebrities, challenging their rights and blurring the lines between fact and fiction. In this age of technological marvels, it becomes increasingly evident that a thoughtful approach is needed to navigate these challenges, all while respecting the broader aspects of cultural expression and the ever-evolving nature of language.
