The petition claimed that the messaging platform\u00a0did\u00a0not\u00a0meet\u00a0the\u00a0principles of\u00a0the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021,\u00a0and\u00a0thereby\u00a0posed\u00a0an immense risk\u00a0to\u00a0the\u00a0fundamental rights\u00a0of\u00a0its users along with\u00a0national security.<\/p><p>A bench comprising Justices M M Sundresh and Aravind Kumar\u00a0declined\u00a0to entertain\u00a0a\u00a0plea filed by Omanakuttan K.G., a Kerala-based software engineer. Omanakuttan&#8217;s\u00a0PIL\u00a0questioned\u00a0the\u00a0vulnerabilities\u00a0in WhatsApp&#8217;s Android application\u00a0for\u00a0allowing\u00a0unauthorized\u00a0changes\u00a0in\u00a0media files.\u00a0This,\u00a0the PIL\u00a0further\u00a0argued,\u00a0would\u00a0become\u00a0a\u00a0possible\u00a0avenue\u00a0for\u00a0undermining\u00a0even\u00a0those persons who are not as technically adept-the privacy, integrity, and security of\u00a0their\u00a0communications.<br \/>The petitioner\u00a0further\u00a0stated\u00a0that\u00a0&#8220;operations of\u00a0WhatsApp\u00a0violate\u00a0fundamental rights&#8221;\u00a0of citizens\u00a0under Article 21 of the Constitution, which guarantees the right to life and personal liberty. Last year, he had filed a similar plea in the Kerala High Court which was dismissed as &#8220;premature&#8221;. The 2021 plea also pleaded enforcement of WhatsApp&#8217;s compliance with the IT Rules, 2021 which mandate tracing the origin of messages for social media intermediaries.<br \/>WhatsApp has also opposed this traceability requirement and, in a plea that followed before the Delhi High Court, argued that it would be against the privacy of the user and also against the principle of end-to-end encryption.<br \/><br \/>The dismissal by the Supreme Court of the latest plea surely shows its unwillingness to interfere with the debate on the IT Rules and the operations of social media platforms.<br \/>Perhaps because the petitioner&#8217;s anxieties constitute potential weaknesses, it is another case of the apex court once more returning its verdict for what has now come to be branded as the judicial mantra that problems of non-compliance with regulations shall be better addressed through administrative measures or existing litigation, such as what WhatsApp is doing in challenging the IT Rules before the Delhi High Court.<br \/><br \/>This judgment, again, highlights the challenges of achieving a delicate balance between user privacy and national security in an era
