(beat her) at the crime scene does not establish a common intention to commit murder.\u00a0However,\u00a0the court\u00a0maintained\u00a0the conviction of\u00a0the\u00a0fourth family member in the case.<\/p><p>The Bench\u00a0of\u00a0Justice Vinay Joshi and Justice Abhay Mantri\u00a0found that\u00a0prosecution\u00a0had\u00a0failed to\u00a0establish\u00a0incrimination\u00a0of the three accused under Section 34\u00a0IPC\u00a0which\u00a0deals\u00a0with\u00a0acts done with common intention.<\/p><p>The case\u00a0started\u00a0with\u00a0the\u00a0murder of Sunanda,\u00a0widow of Vijay Dhabale,\u00a0on\u00a0May 1,\u00a02015, at Pusad in\u00a0Maharashtra.\u00a0After\u00a0her husband&#8217;s death, Sunanda\u00a0was\u00a0staying\u00a0with her in-laws:\u00a0Jayanand Dhabale, his wife Ashabai, and their\u00a0two\u00a0sons,\u00a0Niranjan and Kiran.\u00a0Allegations against the\u00a0family\u00a0apparently\u00a0escalated after\u00a0Dhabales accused Sunanda of\u00a0casting\u00a0black magic\u00a0upon them, which they\u00a0believed\u00a0was\u00a0the cause for\u00a0their\u00a0sicknesses\u00a0and\u00a0bad luck.<\/p><p>Jayanand attacked Sunanda with an axe\u00a0on the morning of the incident\u00a0and\u00a0left\u00a0her\u00a0badly\u00a0injured.\u00a0Niranjan and Kiran,\u00a0too,\u00a0were present\u00a0at the time,\u00a0according\u00a0to eyewitnesses.\u00a0Ashabai\u00a0has\u00a0also\u00a0been accused of provoking\u00a0the attack\u00a0while\u00a0shouting &#8220;mara mara.&#8221;<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"has-el-gap el-gap-default elementor-section elementor-top-section elementor-element elementor-element-49a751b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"49a751b\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-no\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-9a88bed\" data-id=\"9a88bed\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c4bef96 elementor-widget elementor-widget-text-editor\" data-id=\"c4bef96\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"font-size: 16.604px; The accused had contended that there was no preconcerted conspiracy or joint plan to kill her as it might only be presumed from Ashabai&#8217;s words encouraging Jayanand to thrash up Sunanda rather than killing her.<br \/><br \/>In its judgment, the High Court agreed with the defense, pointing out evidence failed to establish a prearranged plan or concerted effort among the accused to commit murder.<br \/><br \/>&#8220;Mere presence at the spot or shouting\u00a0&#8216;mara mara&#8217;\u00a0does not invoke the ingredients of Section 34 of the IPC,&#8221;\u00a0the court stated, emphasizing that there was no proof the accused were aware of Jayanand&#8217;s intent to kill.<br \/><br \/>The court reasoned that Ashabai&#8217;s words could be for beating and not for taking a life, and there are also insufficient materials against Niranjan and Kiran linking them to the crime.<br \/>&#8220;In the absence of common intention, Section 34 of the IPC would not be attracted,&#8221;\u00a0the Bench ruled.<br \/><br \/>Incidentally, Ashabai, Niranjan, and Kiran were acquitted of the criminal charge under Section 302 of the IPC read with Section 34 IPC. The judgment upheld the murder charge against Jayanand who wielded the axe.<br \/><br \/>This judgment also enlightens that solid evidence is required to demonstrate the consensus imminus in criminal
