The\u00a0site\u00a0claims\u00a0that the Centre&#8217;s\u00a0reliance\u00a0on\u00a0the Information Technology (IT) Act to block content\u00a0threatens\u00a0its business model and\u00a0leads\u00a0to\u00a0arbitrary censorship.<\/p><p>X\u00a0argues\u00a0that the government&#8217;s\u00a0use\u00a0of Section 79(3)(b) of the IT Act is\u00a0establishing\u00a0an\u00a0illegal\u00a0parallel\u00a0mechanism for\u00a0blocking\u00a0content. The\u00a0firm\u00a0asserts\u00a0this\u00a0process\u00a0contravenes\u00a0the Supreme Court&#8217;s 2015 Shreya Singhal judgment,\u00a0where\u00a0it\u00a0laid out\u00a0that online content could only be blocked through\u00a0an order by\u00a0a competent court\u00a0or\u00a0through\u00a0the\u00a0ordered\u00a0process\u00a0described\u00a0in\u00a0Section 69A.<\/p><p>Intermediaries,\u00a0under Section 79(3)(b),\u00a0are\u00a0mandated\u00a0to\u00a0disable\u00a0or\u00a0remove\u00a0access to\u00a0illegal\u00a0content upon\u00a0getting\u00a0actual knowledge\u00a0in\u00a0the form of\u00a0a court order or\u00a0government notification.\u00a0Inability\u00a0to\u00a0do\u00a0so\u00a0within 36 hours\u00a0means\u00a0forfeiture\u00a0of\u00a0the\u00a0protection under Section 79(1)\u00a0safe harbour,\u00a0subjecting\u00a0the intermediary to legal\u00a0action\u00a0under the Indian Penal Code (IPC). The latter provision,\u00a0as\u00a0administered\u00a0under\u00a0the Information Technology (Procedure and Safeguards for Blocking for Access of Information by Public) Rules, 2009,\u00a0provides\u00a0for\u00a0a\u00a0systematic\u00a0review process for blocking\u00a0web\u00a0content in the\u00a0name\u00a0of national security, sovereignty, and public order.<br \/><br \/>Moreover, X has\u00a0also\u00a0objected\u00a0to\u00a0the government&#8217;s Sahyog portal,\u00a0which\u00a0was designed\u00a0by the Indian Cyber Crime Coordination Centre (I4C) to\u00a0help\u00a0issue\u00a0Section 79(3)(b) orders. The platform has\u00a0characterized\u00a0this portal\u00a0as\u00a0a &#8216;Censorship Portal&#8217; and\u00a0maintained\u00a0that there is no statutory\u00a0need\u00a0to onboard an employee or\u00a0identify\u00a0a nodal officer for\u00a0the same. X\u00a0asserts\u00a0that it has already appointed officers in\u00a0accordance\u00a0with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.<br \/><br \/>In\u00a0a hearing on March 17, Justice M. Nagaprasanna\u00a0allowed\u00a0X to\u00a0come\u00a0near\u00a0the court if the government\u00a0initiated\u00a0any &#8216;precipitative action&#8217; against the platform.\u00a0But\u00a0the government\u00a0claimed\u00a0that no punitive\u00a0action\u00a0had been\u00a0taken\u00a0against X for\u00a0not\u00a0joining\u00a0the Sahyog portal.<br \/>This legal\u00a0battle\u00a0represents\u00a0a\u00a0serious\u00a0face-off\u00a0between a global\u00a0technology\u00a0giant and the Indian government,\u00a0which\u00a0poses\u00a0essential\u00a0questions\u00a0regarding\u00a0the\u00a0extent\u00a0of online censorship and the\u00a0limits\u00a0of digital regulation in the
