The court suggested that Section 15 of the Hindu Marriage Act, 1955 should be amended to prevent a divorce decree from keeping a spouse\u2019s marital status uncertain for several years merely because an appeal remains pending.<\/p><p class=\"isSelectedEnd\">A Division Bench comprising Justice G.R. Swaminathan and Justice M.D. Sumathi made the observations while dealing with an appeal filed by a husband against a Family Court order granting divorce to his wife on the grounds of cruelty and desertion.<\/p><p>The Family Court had granted the divorce on March 3, 2021. The husband subsequently challenged the decree before the High Court. Following matrimonial disputes, the wife approached the Family Court alleging cruelty and desertion, resulting in the divorce decree in her favour.<\/p><p class=\"isSelectedEnd\">The husband filed an appeal against the decree. The appeal was listed before the High Court on August 9, 2021, but there was no representation on his behalf. Notice was subsequently ordered on August 11.<\/p><p class=\"isSelectedEnd\">Meanwhile, the wife remarried on August 27, 2021, and the marriage was registered on September 2, 2021. The appeal was eventually dismissed for non-prosecution on November 5, 2025, before being restored on March 30, 2026.<\/p><p class=\"isSelectedEnd\">The High Court noted that there had been no interim stay against the divorce decree during the relevant period.<\/p><h3>Court Questions Prolonged Uncertainty<\/h3><p class=\"isSelectedEnd\">Examining Section 15 of the Hindu Marriage Act, the Bench noted that the provision permits a divorced person to remarry in specified circumstances, including where an appeal has been dismissed or where the prescribed period for filing an appeal has expired without an appeal being filed.<\/p><p class=\"isSelectedEnd\">The court observed that merely filing an appeal does not, by itself, suspend the operation of a divorce decree. In the absence of an interim stay, the decree continues to remain effective.<\/p><p class=\"isSelectedEnd\">Referring to earlier Supreme Court rulings, including <em>N. Rajendran v. S. Valli<\/em>, <em>Krishnaveni Rai v. Pangaj Rai<\/em> and <em>Lila Gupta v. Laxmi Narain<\/em>, the Bench noted that the legal position must also account for the consequences of a prolonged appeal.<\/p><p class=\"isSelectedEnd\">The court expressed concern that allowing an appeal to remain pending for years could leave a person who has obtained a divorce in a prolonged state of uncertainty, particularly when the person wishes to rebuild their life through remarriage.<\/p><h3>Two-Month Window Suggested for Stay<\/h3><p class=\"isSelectedEnd\">The Bench suggested that Section 15 should be reconsidered so that filing an appeal within the prescribed limitation period is not, by itself, sufficient to prevent remarriage.<\/p><p class=\"isSelectedEnd\">According to the court, an appellant should also be required to secure an interim stay of the divorce decree within <strong>two months<\/strong> of filing the appeal. Such a mechanism, the court indicated, could strike a better balance between the right to challenge a divorce decree and the right of the divorced spouse to move forward with their life.<\/p><p class=\"isSelectedEnd\">The court observed that the <strong>right to marry is a human right, subject to legal conditions<\/strong>, and indicated that the existing statutory framework may require legislative intervention to address the uncertainty created by prolonged matrimonial appeals.<\/p><p>Since the wife had already remarried in the present case and there was no stay operating against the divorce decree, the High Court found no effective relief that could be granted in the appeal and dismissed the matter as
