In a week that has seen the Indian judiciary make headlines for all the wrong reasons, two incidents stand out. The first involves Justice Pankaj Jain of the Punjab and Haryana High Court, who made homophobic remarks in open court, sparking widespread condemnation. The second incident involves the Supreme Court criticising a judgment by the Calcutta High Court that advised adolescent girls to suppress their sexual urges.
Justice Jain’s remarks, made in response to a case involving a same-sex couple, were not only offensive but also in stark contrast to the 2018 Supreme Court verdict that decriminalised homosexuality and affirmed the rights of the LGBT community. His assertion that “constitutionality and morality are different” has ignited a debate about the role of personal beliefs in judicial proceedings.
On the other hand, the Calcutta High Court’s advice to adolescent girls to suppress their sexual urges was deemed “highly objectionable and completely unwarranted” by the Supreme Court. The apex court rightly pointed out that such remarks violated the rights of adolescents under Article 21 of the Constitution.
These incidents highlight the need for the judiciary to uphold the rights and interests of all citizens, regardless of their sexual orientation or age. They also underscore the importance of separating personal beliefs from judicial duties. After all, the rule of nature and respecting the autonomy of the body should be placed far above personal morality or a written code. As the guardians of justice, judges must remember that their words carry weight and can have far-reaching implications.
