In a significant move, the Bar Council of India (BCI) has announced that it will likely introduce and enforce new regulations by the end of July to allow foreign lawyers and law firms into the Indian market. Initially, this change will apply exclusively to lawyers and law firms from the United Kingdom (UK).
This development was unveiled at a meeting held at the Law Society’s Hall in London, where BCI officials convened with representatives from the Law Society and the Bar Council of England and Wales. The announcement marks a pivotal step in the ongoing efforts to open up India’s legal sector, which saw a major push in March last year. At that time, the BCI had notified the Bar Council of India Rules for the Registration and Regulation of Foreign Lawyers and Foreign Law Firms in India, 2022.
Further clarification came on March 19, 2023, when the BCI issued a press release. It stated that foreign law firms would be permitted to establish offices in India, but only for advising their foreign clients on matters of foreign law. Despite this announcement, the implementation of these rules faced delays. The Society of Indian Law Firms (SILF) raised several objections, and the Law Society and Bar Council of England and Wales sought additional clarity. The issue was further complicated by a petition filed in the Delhi High Court challenging the rules.
During the recent meeting in London, various aspects of the proposed regulations were thoroughly discussed, with the aim of addressing outstanding concerns and ensuring a smooth rollout.
