Every year, firecrackers are banned in the capital, but low turnout means it remains full for days afterwards
The Supreme Court rebuked the Delhi government for its ineffective measures to curb rising air pollution, especially after Diwali celebrations. The Court emphasized the need to enforce pollution controls, particularly regarding firecracker usage.
A bench headed by Justice S. Oka also commented that the ban had “barely been implemented” by the Delhi government, and the pollution during Diwali was such that it was extreme. The Court again called for evidence from the Delhi government on enforcement issues, which also raised the question of current arrangements.
The bench asked Delhi government to clarify the stand of the firecracker ban and told who was responsible to enforce the ban and asked if the ban was notified under the Environment Protection Act. Justice Oka felt the need for accountability so called for a prompt reply from the authorities in Delhi.
Justice Oka has called upon the Delhi administration and appropriate authorities to consider a “lifetime ban” on firecrackers for this annual reason. Still, according to Justice Oka, firecrackers were coming from neighboring states into Delhi, and some public awareness campaign before Diwali could help ensure compliance. Court Reforms of the Future Practice The court directed the Delhi Police Commissioner and government to come up with a strong enforcing mechanism so that such scenarios don’t arise in the future again. The Delhi government as well as police were also advised to come up with crystal-clear effective strategies for the approaching Diwali celebrations that should prevent public health and low-level pollution.
