A Jaipur family court has granted a divorce after finding that a wife’s alleged relationship with another man, including observing a Karwa Chauth fast for him, amounted to mental cruelty in the circumstances of the case
A 13-year-old marriage has been dissolved by a Jaipur family court after the husband’s allegations of mental cruelty were found to be supported by the evidence. The wife’s alleged relationship with another man, including the observance of a Karwa Chauth fast for him, was considered by the court while assessing the breakdown of trust between the couple.
Family Court-2 Judge Vishal Bhargava granted the divorce after the husband’s claims regarding his wife’s conduct and their deteriorating marital relationship were examined. The court reportedly found that the wife’s behaviour towards the other man had gone beyond the boundaries of ordinary friendship and had contributed to the loss of trust within the marriage.
The divorce petition had been filed on January 27, 2023, with allegations of mental harassment and the wife’s refusal to continue the marital relationship. It was also claimed that physical intimacy between the couple had ceased in 2019. The court noted that the spouses had been living separately for more than a year.
Karwa Chauth Fast Becomes Key Issue
A specific allegation concerned October 24, 2021, when the wife was said to have observed Karwa Chauth in Goa for another man and treated him as her husband. According to the husband’s claims, considerable time had been spent by the wife with the individual, and a relationship beyond ordinary friendship had developed between them.
The husband’s allegations also included claims of disrespectful behaviour towards his parents and inadequate care for their minor son. It was further alleged that false complaints had been filed against him, causing him mental distress.
Marital Trust Found to Have Broken Down
After considering the allegations and evidence presented in the proceedings, the court concluded that mental cruelty had been established in the circumstances of the case. The conduct attributed to the wife was found to have seriously undermined marital trust and made the continuation of the relationship difficult.
The divorce was accordingly granted, bringing the long-standing marital dispute before the family court to a legal conclusion.
